MINUTES OF 152nd  MEETING OF NORTHERN REGIONAL COMMITTEE HELD ON 23rd  TO 25th November, 2009

 

The 152nd meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from 23rd to 25th November 2009 at Jaipur. The following members and convener were present:

    1. The State Govt. Recommendation letter no. 1497/sattar-6/2008-2(268) dated 09.06.2008 was negative.
 

      After the rejection the institution filed a writ petition in the Hon’ble High Court, Allahabad, Uttar Pradesh vide writ petition no. 54264/09.

 

      The Hon’ble High Court, Allahabad, UP has passed an order with the direction to pass appropriate orders on the pending matter relating to grant of approval for running B.Ed. course in accordance with law within a period of three months from the date of production of certified copy of this order.

Hon,ble High Court, Allahabad, U.P has directed to grant approval as per law. Since from 2010 – 2011 academic session there is a ban, so recognition cannot be granted.

FILE NO. UP-3313, COURSE – B.ED.

      The institutions application was rejected in NRC’s 142nd Meeting held on 22nd – 23rd December, 2008 due to  the following reasons”-  
  1. The land is on private lease for thirty years which is not as per clause 8(7) of Regulations, 2007.
  2. The submitted Building Plan is not approved by competent authority.
 

      After the rejection the institution filed a writ petition in the Hon’ble High Court, Allahabad, Uttar Pradesh vide writ petition no. 26357/09.

 

      The Hon’ble High Court, Allahabad passed an order are as follows:-

 

      The application of the petitioners for grant of recognition and permission to run B.Ed. Course has been rejected by the Northern Regional Committee, Jaipur, Rajasthan. Accordingly to the learned counsel for the petitioners both these grounds taken for rejection are contrary to the Regulations of the National Council for Teacher Education. In this regard the petitioners propose to submit a fresh representation to the Northern Regional Committee explaining how the defects stand removed. In case any such representation is submitted along with a certified copy of this order the Northern Regional Committee may consider and decide the same within a period of six weeks thereafter strictly in accordance with law.

As the land is on private lease for thirty years but as per NCTE Regulations Clause 8(7) the land could be either on ownership basis or on lease from Government / Government Institutions for a period of not less than 30 years. Hence, the application for B.Ed. programme cannot be considered.

MAA SHARDA RAJNARAYAN RAI SMARAK MAHAVIDYALAYA, PALI- GHAZIPUR, UTTAR PRADESH  

FILE NO. – 2860, COURSE – B.ED.

      The institution’s application was rejected in NRC’s 135th Meeting held on 22nd – 23rd December, 2008 due to the following reasons”-  
  1. The State Govt. Recommendation letter no. 1000/sattar-6/2008-2(112) dated 15.04.2008 was negative.

 

      After the rejection the institution filed a writ petition in the Hon’ble High Court, Allahabad, Uttar Pradesh vide writ petition no. 43695/09.

 

      After hearing counsel for the parties and perusing the records it transpires that the basis for refusing to grant ‘No Objection Certificate’ by the State Govt. on the strength of Government order dated 11.02.2005 has gone as the Govt. order dated 11.02.2005 has been rescinded by the State Govt. on 01.06.2009 therefore the consequential rejection of the recognition by the NCTE requires to be considered. In view of the writ petition is disposed of with the observation that the petitioner may approach to State Govt. as well as NCTE along with certified copy of the order passed by this court with formal application before both the respondents. In case such application is filed, the State Govt. shall reconsider the matter to grant of “No Objection Certificate”. In view of the Government Order dated 01.06.2009 in accordance with law within a period of three weeks from the date of receipt of the petitioner’s application along with the certified copy of the judgment of this court and the decision taken on petitioner’s application be communicated to the NCTE within further period of two weeks and it is thereafter the respondent no. 3 shall pass appropriate order on the form of the petitioner for grant of recognition in accordance with law within a further period of three weeks from the date of receipt of the order of State Government on the petitioner’s application for grant of “No Objection Certificate”.

It cannot be considered because the NOC to be issued by State Government has not been submitted by the Institute yet.

DEEPANSHU COLLEGE OF PROFESSIONAL STUDIES, CHUNATI GADA, DELHI ROAD, DISTT.- SAHARANPUR, UP  

FILE NO. – 3145, COURSE – B.ED.

      The institution’s application was rejected in NRC’s 140th Meeting held on 25th – 26th April, 2009 due to  the following reasons”-  
      1. Application is not on the Prescribed Format.
      2. Copy of Approved Building Plan.
      3. Land Use Certificate.
      4. FDR For Rs. Five Lacs.
      5. FDR For Rs. Three Lacs.
      6. Building Completion Certificate.
 

      After the rejection the institution filed a writ petition in the Hon’ble High Court, Allahabad, Uttar Pradesh vide writ petition no. 50104/09.

 

      The Hon’ble High Court, Allahabad, UP, Considering the facts and circumstances of this case, this petition is disposed of with liberty to the petitioner to submit a fresh representation as observed above within a period of 15 days from today along with certified copy of this order and upon receipt thereof, the Northern Regional Committee, Chaired by the Regional Director of the committee, respondent no. 2 shall consider the same and pass appropriate orders within a period of two months from the date of receipt of the same in accordance with law.

As per the Hon’ble High Court, Allahabad, UP, directions the Institution was required to submit that how the discrepancies pointed out by NRC, NCTE, Jaipur have been removed and also  submitting the relevant documents in support there of. The Institution has not submitted the same. Hence, the application cannot be considered.

IIMT COLLEGE OF EDUCATION, O-POCKET, GANGA NAGAR, NAWANA ROAD, MEERUTM UP,  

FILE NO. UP-2484, COURSE B.P.ED.

      The application institution was granted recognition on 03.07.2009 with the direction to register the land in the name of the institution within six months.  

      After the recognition the institution filed a writ petition in the Hon’ble High Court, Allahabad, Uttar Pradesh vide writ petition no. 55736/09.

 

            The Hon’ble High Court, Allahabad, UP has passed a order, the clause 11 of the order dated 03.07.2009 passed by the Regional Director of the Northern Regional Committee. National Council for Teacher Education shall remain stayed and the petitioner shall not be compelled to execute the sale deed.

     7        6. LORD KRISHNA COLLEGE OF EDUCATION,

VILL. &  PO. SIWANI BOLAN, DIST. HISAR, HARYANA  

HR-1731

COURSE: B.ED.

The institution has submitted application for recognition of B.Ed. course on 21.7.2008 under section 14 of NCTE Act.   

Inspection has been conducted on 7.9.2008.

 

The recognition of the institution has been refused on 23.4.2009 as per the decision of the NRC in its 139th meeting for the following reasons :-

  • CLU is not issued by the competent authority on the prescribed format
  • In response to our letter, the State Govt recommendation is negative
 

The institution had preferred an appeal against the above decision of NRC on 22.6.09.  The appeal has also been rejected by the appellate authority and confirmed the NRC order appealed against vide their order dated 7.8.09.

 

Aggrieved by the above decision of the appellate authority the inst has filed a writ petition before the Hon’ble High Court of Delhi. The High Court has set aside the Council’s order dated 7.8.09 and remanded the matter to the Council for consideration afresh. 

The Council, as per the directions of the Hon’ble High Court, has reconsidered the matter on 4.9.09 and remanded to NRC for conducting an inspection and taking an appropriate decision thereafter vide their order dated 4.9.09.  The matter was placed before NRC in its 150th meeting.  The NRC has decided to conduct inspection.  The institution has filed a Writ petition No. 12154/2009 and.  Legal opinion was sought from the NRC counsel at Jaipur, Shri Sanjay Pareek, Advocate on the Judgment dated 22.10.09, “.. in order to avoid any serious consequences recognition may be granted and institution may be asked not to press for cost part of the judgment…”  

A Contempt petition No. 767/2009 has also been filed by the inst.

Implement the orders of Hon’ble High Court of Delhi.
    8 7 GURUDHAM COLLEGE OF EDUCATION, KHEDAR, 6TH K.M. STONE, HISAR ROAD, NH-65, THE. BARWALA, DIST. HISAR, HARYANA

COURSE : B.ED.

The institution has submitted application for recognition of B.Ed. course on 25.7.2008 under section 14 of NCTE Act.   

The application of the institution has been closed as per the decision of NRC in its 140th meeting vide order dated 12.5.2009.

 

The institution has filed a Writ petition No. 9908 of 2009 before the Hon’ble High Court of Punjab & Haryana.  The Court has directed to reconsider the application of the petitioner for grant of recotnition in the light of Sale deed(produced efore the Court) and pass final order within four weeks vide order dated 8.7.09.

 

The institution has preferred an appeal u/s 18 of the NCT Act on 18.5.09. The appeal has been rejected and NRC’s above closer order has been confirmed by the appellate authority vide their order dated 7.8.09.

 

The institution has again filed a Writ petition No. 13802 of 2009 before the Hon’ble High Court of Punjab & Haryana. The Court has directed to pass a fresh order in the light of the directions contained in the order dated 8.7.09, needful be done within a period of two weeks from the date a certified copy is received by the competent authority. 

 

The above matter has been referred to our Legal counsel, Shri Tibrewal.  Same is placed in File for kind perusal.

    9 8 DRONACHARYA INSTITUTE OF TEACHER EDUCATION, SHIMLA BYEPASS ROAD, DHARMAWALA, VIKAS NAGAR, DEHRADUN, UTTRAKHAND

COURSE: B.Ed.

The institution has submitted application for recognition of B.Ed. course on 24.12.04 under section 14 of NCTE Act.   

Inspection has been conducted on 15.6.2005.

 

Recognition has been granted on 01.7.2005 for B.Ed. course with an intake of 100 w.e.f. 28.6.2005.

 

An inspection has been conducted under section 17 on 17.6.2009. 

 

The matter has been placed before NRC in its 146th meeting.  The committee has decided to withdraw recognition. 

 

The institution has filed Writ Petition No. 1626(MS) of 2009 in the Hon’ble High Court of Uttranchal.  The Court has directed that, “till next date of listing the decision taken by the respondent no 3 in its meeting dated 5-7th August 2009 shall not be given effect to.  

        List this petition in the week commencing 5th October 2009 alongwith Writ Petition 1403/2009(M/S).  in the meantime the respondents may file counter affidavit”.

    • Dr. (Ms) Renu Singh holds Ph.D in Sanskrit and MA in Education where as the facts are misrepresented in the submitted affidavit mentioning there by Ph.D. In Education and M.Ed. / MA (Education). Thus, she is not qualified as per NCTE norms for M.Ed.
    • Dr. Nempal Singh is having MA (Education), M.Sc. (Physics), B.Ed. and Ph.D. (Physics) degrees. He does not have M.Ed. degree as per NCTE norms.
    • The College has appointed two lecturers in place of three lecturers.
    • One Professor has not been appointed.
 
Hence, the committee directs the Institution to appoint teaching staff as per NCTE Norms for M.Ed. within 90 days.

NOW THEREFORE, THE COUNCIL HEREBY REVERSES THE ORDER APPEALED AGAINST.

    • The Faculty for M.Ed. is to be appointed as per NCTE norms for M.Ed. and documents related to experience certificate, mark sheets, affidavits on Rs. 10 and Rs 100 are to be submitted.

  • The building plan showing multipurpose hall is not approved by competent authority.
  • Documents related to qualification and experience of HOD has not been submitted.

  • As per norms for additional B.Ed. intake, the Institution is required to submit the accreditation certificate from NAAC. This has not been complied with.

RJ- 2242) 89-649/2009-apeal The Council has accepted the appeal and remanded the case to NRC for further processing of the file for additional intake on the basis of merit. The council has reversed the order of NRC.  

Remarks of office:

The institution has submitted documents vide letter received in office on 19.11.2009

  • Dr. Vishwas saxena appointed as Reader is not qualified as per NCTE norms for M.Ed.
  • The list of appointed Faculty pertains to 2008 which is too old. Thus, the Institution is directed to submit the fresh list of appointed Faculty as per NCTE norms for M.Ed.
Hence, the committee directs the University to appoint Faculty as per NCTE norms for M.Ed.  Within 60 days.
20 11 M.J.R.P COLLEGE OF EDUCATION, N.H.-8, NEW DELHI ROAR, VIL- KANT, POST- ACHROL, DISTT- JAIPUR, RAJASTHAN (M.ED., RJ-2246) 89-767/2009-apeal The appeal has been accepted and set aside NRC’s order dated 01.06.2009 and remanded the case to NRC for causing inspection of the institution within a month of issue of this order to ascertain the availability of infrastructure and instructional facilities as per NCTE norms and thereafter pass appropriate order.
  • VT is to be constituted.
21 12 TIKA RAM GIRLS COLLEGE, SONEPAT, MISSION ROAD, SONEPAT-131001, HARYANA. (C.P.Ed.,HR- 249) 89-710/2009-apeal The appeal reversed NRC order dated 15.07.2009 with direction to the NRC to issue the recognition order under clause 7(11) of the NCTE regulation, 2007 within 15 days of issue of this order. Implement the decision of the appeal committee and issue recognition order under clause 7(11).
